Which California Lottery prizes are tax-free in California?
All of them. The exemption dates from 1984, when California voters approved the initiative that created the state lottery, and it's now Government Code section 8880.68, which bars state and local taxes on lottery ticket sales and on prizes awarded by the lottery. The Franchise Tax Board's instructions for Schedule CA tell residents the same thing: California Lottery winnings aren't taxable in California, while lottery winnings from other states are.
The exemption covers every game the California Lottery sells: SuperLotto Plus, Fantasy 5, Daily 3 and the other daily games, Scratchers, and Powerball and Mega Millions tickets sold in California. There's no dollar cap. A $20 Scratchers win and a billion-dollar jackpot are treated the same way. You still report the prize on your federal return, and you subtract it out on your California return.
How much federal tax do California lottery winners pay?
The same as anywhere else. Lottery prizes are taxable income under the federal rules for gambling income. When a prize, minus what you paid for the ticket, is more than $5,000, the lottery withholds 24% for federal tax, according to the IRS instructions for Form W-2G. Non-resident aliens are generally withheld at 30%.
Withholding isn't the final bill. A jackpot puts you in the 37% bracket, so a large winner usually owes roughly another 12 to 13 percent of the prize when filing. On a jackpot with a $500 million cash value, total federal tax comes to about $185 million, leaving about $315 million. Setting the extra amount aside at claim time avoids a surprise in April. Worked examples are in tax on big jackpot wins.
What is California's exemption worth on a big jackpot?
Here's the same $500 million lump sum claimed by a resident of three places. The state figures use top marginal rates and are approximate.
| Where the winner lives and buys | State and local tax on top of federal | Approximate take-home |
|---|---|---|
| California | None | About $315 million |
| Oregon (9.9% top rate) | About $49 million | About $266 million |
| New York City (10.9% state, 3.876% city) | About $74 million | About $241 million |
New York City is the most expensive place in the country to win; see why New York lottery taxes are the highest. A short list of other lottery states also leaves lottery prizes untaxed, mostly because they have no income tax. The full comparison is in lottery tax rates by state.
When do Californians pay state tax on gambling winnings?
The exemption is narrow. It applies to prizes from the California Lottery and nothing else, so a few situations catch people out.
If you're a California resident and you win on a ticket bought in another state, say Arizona or Oregon, California taxes that prize as ordinary income. The selling state may tax it too, in which case California generally gives a credit for tax paid to the other state.
Casino, card room, racetrack and sports betting winnings are all taxable in California. A jackpot on a Las Vegas slot machine goes on your California return. (Nevada has no lottery of its own, so a lottery prize can't come from there.)
Visitors get the benefit in reverse. Someone who lives in another state and wins on a California ticket owes no California tax, but their home state will usually tax it. The rules for visitors from abroad are in lottery taxes for non-residents and immigrants.
Finally, the prize is exempt but what it earns afterward isn't. Interest, dividends and capital gains on invested winnings are taxed by California like any other investment income.
Why doesn't California tax lottery winnings?
Because the 1984 initiative said so, and the state gets its money another way. A share of every ticket sold goes to public education: K-12 schools, community colleges and the state universities. The California Lottery reports raising about $1.9 billion for public education in the 2024-25 fiscal year (who benefits). The same law is the reason every California prize is pari-mutuel rather than a fixed amount, explained in why California lottery prizes vary.
